Injured in a crash while working? Should you take workers comp or PIP?

A lot of our clients are injured in Maryland vehicular crashes while they are working. This brings up a threshold question. Should they elect PIP benefits or workers compensation?

The answer is not invariably clear but a simple idea is worth keeping in mind when you make this decision. There are advantages in PIP, in that it will pay 85% of your pre-tax wages and any PIP paid is not a lien on your settlement. The disadvantages are that PIP is limited. The maximum in-state PIP policy is $10,000.00 and the most frequently purchased PIP is $2500.00.

So for smaller cases where the wage loss and medical expenses aren't a lot PIP often works better. For cases where the medicals and wage loss are likely to be more than your PIP coverage, workers comp. provides the best protection.

To be clear each individual car or truck accident has its own unique facts and insurance coverages and consulting a lawyer is important to making the correct choice.
