The answer is not invariably clear but a simple idea is worth keeping in mind when you make this decision. There are advantages in PIP, in that it will pay 85% of your pre-tax wages and any PIP paid is not a lien on your settlement. The disadvantages are that PIP is limited. The maximum in-state PIP policy is $10,000.00 and the most frequently purchased PIP is $2500.00.

So for smaller cases where the wage loss and medical expenses aren't a lot PIP often works better. For cases where the medicals and wage loss are likely to be more than your PIP coverage, workers comp. provides the best protection.
